The explanations we provide on this page regarding your Personal Data also cover your Special Category of Personal Data.

  • Family Member Data: Data about the family members and close relatives of relevant individuals, collected from our employees, job applicants, and subcontractors and authorized personnel and employees of institutions with whom we have business relationships, in order to protect the legal and other interests of our company or the relevant individual as required by relevant legislation.
  • Financial Data: Data such as salary, wage information, and bank account information collected from our employees, job applicants, customers, business partners, subcontractors and authorized personnel and employees of institutions with whom we have business relationships, in accordance with the legal relationship established with the relevant individual.
  • Personnel Data: All types of personal data that form the basis for the establishment of personnel rights of natural persons who work with our company, collected from our employees, job applicants, and subcontractors and authorized personnel and employees of institutions with whom we have business relationships.
  • Physical Location Security Data: Personal data such as security and camera recordings taken during entry to the physical premises and during the stay within the premises, collected from our customers, business partners, employees, job applicants, visitors, and subcontractors and authorized personnel and employees of institutions with whom we have business relationships.
  • Communication and Complaint Management Data: Personal data obtained from our customers, business partners, users of our platforms (internet/mobile sites and applications), visitors, and subcontractors and authorized personnel and employees of institutions with whom we have business relationships during the processes of receiving and evaluating any type of requests or complaints directed to our company.
  • Special Category of Personal Data: Data such as health data, biometric data (voice and video recordings), religion, and information about association or union memberships collected from our customers, business partners, employees, job applicants, visitors, and subcontractors and authorized personnel and employees of institutions with whom we have business relationships, as specified in Article 6 of KVKK.
  • Other Data: Data processed for technical operational security, purchase information, cookies, and other data collected automatically through automatic or any other means by various methods, collected from our customers, business partners, employees, job applicants, users of our platforms (internet/mobile sites and applications), and subcontractors and authorized personnel and employees of institutions with whom we have business relationships.

b. How and on What Legal Grounds Do We Collect/Process Your Personal Data?

We collect your Personal Data through the following primary purposes and methods, and through other channels that may be added in the future, using automatic or non-automatic means, whether verbal, oral, written, or electronic.

We collect your Personal Data through our internet and mobile platforms (internet/mobile sites and applications), social media channels operated in the name of Arzular Metal Casting Industry on various social media platforms, our call center managed by Arzular Metal Casting Industry, email, short messages (“SMS”), or multimedia messages (“MMS”), among other communication methods; through contracts signed with you or your authorized company in the scope of our sales and marketing activities, commercial offers provided, printed and electronic forms, business visits where you provide business cards and other documents, through third parties such as our group companies, business partners, distributors and sales channels, manufacturing companies, or firms supplying products/services, and through various channels including trade registry and other sources, using various methods that are entirely or partially automatic or part of any data recording system.

  • Transfer of personal data to third parties located in Turkey; Personal Data may be transferred by the company to third parties located in Turkey without obtaining explicit consent in exceptional cases defined in Articles 5.2 and 6.3 of KVKK or with obtaining explicit consent from the relevant individual (Articles 5.1 and 6.2 of KVKK).
  • Transfer of personal data to third parties located abroad; Personal Data may be transferred by the company to third parties located abroad without obtaining explicit consent in exceptional cases defined in Articles 5.2 and 6.3 of KVKK or with obtaining explicit consent from the relevant individual (Articles 5.1 and 6.2 of KVKK). However, the following conditions must be met regarding the foreign country to which the data is transferred:
    1. The foreign country to which personal data is transferred is recognized by the Council as a country with adequate protection,
    2. If the foreign country to which the transfer will take place is not listed on the Council’s list of secure countries, the company and the Data Controllers in the relevant country must obtain written assurance that adequate protection will be provided and obtain permission from the Council.

e. Your Rights and Application Procedures

e.1. Your Rights Regarding Your Personal Data

We would like to inform you that you have the following rights regarding your processed data within Arzular Metal Casting Industry and its affiliates:

  1. To know whether your Personal Data is being processed,
  2. To obtain information about your Personal Data if it is being processed,
  3. To know the purpose of processing your Personal Data and whether it is being used in accordance with that purpose,

e.2. Application

You can submit your requests regarding your Personal Data by filling out the application form linked below:

  1. Submitting it to our consulting office at our company’s address listed in the Data Controller Identification Information section or by sending a notification via Notary to the same address,
  2. Submitting it via registered electronic mail.

Arzular Metal Casting Industry will address your requests promptly and conclude them free of charge within thirty (30) days at the latest, depending on the nature of the request. If fulfilling your requests incurs any cost, we may charge you only the fees determined by the Personal Data Protection Board in accordance with the law.

Arzular Metal Casting Industry may accept or reject your requests by explaining the reasons and communicate this response in writing or electronically to the person making the request. If your request is accepted, Arzular Metal Casting Industry is obliged to fulfill the request immediately.

e.3. Complaint

If your requests are rejected by Arzular Metal Casting Industry, you are not satisfied with the response provided by Arzular Metal Casting Industry, or if no response is given, you can file a complaint with the Personal Data Protection Board within thirty (30) days from the date the response was communicated to you and within thirty (30) days from the end of the thirty (30) day period if no response is given.

KVKK Application Form

Under the Law No. 6698 on the Protection of Personal Data (“KVKK”), individuals defined as personal data subjects (“hereinafter referred to as “Applicant”) are granted certain rights to make requests regarding the processing of their personal data as per Article 11 of KVKK. According to the notification on Application Procedures and Principles for Applications to the Data Controller (dated 10/03/2018 and numbered 30356), applications regarding these rights must be submitted to our Data Controller Company in person, in written Turkish, and through the methods specified below.

Below are the details on how written applications should be submitted to us.

Information to be Filled Out During the Application:

  • Name, surname, and signature if the application is written,
  • For Turkish citizens: Turkish ID number; for foreigners: nationality, passport number, or if available, ID number,
  • Residential address or business address for service delivery,
  • If available, the email address, phone, and fax number for notification purposes,
  • Subject of the request.

Additionally, information and documents related to the subject should be attached to the application.

If you wish to make an application regarding your personal data, the application form below must be filled out completely. This application form is arranged to accurately identify your relationship with our company, determine the Personal Data processed by our company if any, and respond correctly and within the legal timeframe to your application. To eliminate legal risks that may arise from unlawful and unjust data sharing and to ensure the security of your personal data, our company reserves the right to request additional documents and information (such as a copy of your ID card or driver’s license) for identity and authority verification. If the information provided in the form is incorrect or an unauthorized application is made, our company does not accept liability for requests arising from such incorrect information or unauthorized applications.

Applications submitted to us will be responded to in writing within thirty (30) days at the latest, free of charge, in accordance with Article 13 of KVKK, paragraph 2, depending on the nature of the request.
